    Missing parts

    A friend of mine received an Airfix 1:48 Mosquito for Christmas and found that one of the sprues was missing, He contacted Airfix who assured him they would post a replacement to him as soon as. By the end of January the replacement had not arrived so he contacted them again and they said it must have got lost in the post and that they didn't have anymore available. So he contacted the online store it was ordered from who told him to contact Airfix as it was not their problem. He has now asked the seller to either refund him or replace the model. Has anyone any ideas as to where the replacement sprue can be obtained from?

    Don't quote me on this Airfix should issue the part free, if not the seller is duty bound as well as in good faith post a new kit out if you have the receipt, i know this used to be the case with ERTL kits.

      I agree that Airfix should replace the part that is missing, that is why they have a department just for that. However, if they cannot/will not, it could be argued that the retailer has the responsibility under the sales of goods act that the item sold should be 'fit for purpose'. No one could disagree that a construction kit that has parts missing cannot be constructed and is therefore not fit for purpose. However, under the circumstances it would be fair to expect a replacement kit from the retailer who would then have to take it up with their wholesaler rather than a refund. Your guarantee in the UK is with the retailer not the wholesaler or manufacturer.

        Yes Graham has it right,

        it is always best to go to the Seller first as the contract of sale is with them NOT with the manufacture, if they then suggest to contact the manufacturer as it my be quicker then it is Ok to do so, but the contract is still with the seller. If it was purchased online then I would say that it was a good chance that a credit card was used (Not debit card) and recourse could be gained through the credit card company

          I also not to long ago had a part missing from two airfix kits and it took them nearly 8 weeks to replace, From what i have heard on the grape vine the spare parts dept is a complete mess with things going missing all the time. Another buyer from a model shop buys all his kits from America and can have them delivered within 3-4 days, Airfix however take 4-6 weeks to deliver. The same buyer also ordered Humbrol paints at the end of October and had them on his door step in the 3rd week of January.

          I agree that if a product is not fit for purpose then the supplier should refund the monies to the buyer. If you are having no luck just get in touch with the Trading Standards section of the local authority and they will help free of charge, no company that i know of enjoys trading standards knocking at the door no matter how small the problem.

          I should also say that it has not put me off from buying Airfix kits as i still do.

            yep, i'm with Graham on this one. The Sale of Good act states that the issue is between you and the retailer. The place where the Mossie was bought from should fully refund the costs.

              Thanks everyone, Airfix didn't come up with the goods at all but the merchant did eventually replace the kit, but only after Airfix started to play silly B's and there was some discussion around the sales of goods act. So all's well that ends well. Thanks again for your help.
